When POTUS, Senate hold majority with same party a justice is voted on, says legal expert

Legal Fellow at Heritage Zack Smith said the president has a duty to nominate someone into that seat.

Trump has committed himself to nominating someone by the end of the week and McConnell said he will confirm the nomination.

Smith said that is exactly how this process is supposed to go.

He said the biggest difference between the process in 2020 and the process in 2016 is that this year, the Senate majority and the president are of the same party. This switches the game a little bit.

Historically, when the Senate majority and the president are the same party there is a nomination by the president and a vote by the Senate.​
